Terms of Service

These Terms of Service (“Terms”) govern your use of TapThisTag’s website, tags, and services (the “Service”), operated by Lead512 LLC, 13359 N Highway 183, Suite 406-1317, Austin, TX 78750 (“TapThisTag,” “we,” “us,” or “our”). By purchasing a product, creating an account, or using any TapThisTag service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services or purchase our products.

The Service

TapThisTag provides NFC pet tags and a web app where you create a public profile for your pet. When someone taps a tag with a smartphone, it opens the profile you control. Features may change or improve over time. The Service is intended as a supplementary identification tool and does not replace microchipping, GPS tracking, or other pet safety measures.

User content & platform status

All information displayed on public pet profiles is provided voluntarily by the user, not by TapThisTag. We are not the publisher or speaker of user-generated content and are not liable for what users choose to display on their public profiles. You are solely responsible for the accuracy, completeness, legality, and appropriateness of the information you publish, including phone numbers, addresses, and personal details.

Your account

You are responsible for the information you add and for keeping your contact details accurate. You must have the right to share any information and images you upload, and you agree not to post unlawful, harmful, or misleading content.

Public profile — assumption of risk

Your pet’s public profile page is accessible to any person who taps your NFC tag or opens the profile URL, without requiring an account or login. By choosing to display personal information — including but not limited to phone numbers and home addresses — you voluntarily assume all risks associated with making that information publicly accessible. We provide tools to control what is displayed and strongly recommend enabling only the minimum necessary information. TapThisTag is not liable for any consequences resulting from information you choose to make public.

Purchases

• Tags are sold as a one-time purchase. Pricing and availability are shown at checkout.
• Creating and managing your pet’s profile does not require a subscription.
• Any refund or money-back terms shown at checkout apply to your order.

Tags & transfers

A tag is tied to your account once claimed. You may add more than one tag to the same pet, reassign a tag to another of your pets, or release it so a new owner can claim it with its code. You agree not to attempt to claim tags that are not yours.

Acceptable use

Don’t misuse the Service — for example, by attempting to access others’ data, interfering with the Service, scraping, or using it to harass or endanger anyone.

Text message alerts (SMS)

Programme name: TapThisTag Lost Pet Alerts. If you opt in on our text-alerts page at tapthistag.com/sms — the only place we collect it — you agree to receive automated text alerts from TapThisTag when your pet’s tag is scanned while that pet is marked lost. That is the only kind of text we send; we send no marketing or promotional messages. Opting in is optional and is not required to buy a tag, create an account, complete a purchase, or use any part of the Service, and we never ask for it during checkout or signup.

• Message frequency varies — you receive a text only when your pet’s tag is scanned while marked lost.
• Message and data rates may apply.
• Reply STOP to any message to opt out at any time. You will receive one confirmation and no further messages.
• Reply HELP for help, or contact us at support@tapthistag.com or tapthistag.com/contact.
• You must be the owner or an authorised user of the mobile number you enter, and at least 18 years old.
• Carriers supported include AT&T, T-Mobile, Verizon and other US carriers. Mobile carriers are not liable for delayed or undelivered messages.
• No mobile information — including your phone number and your SMS opt-in/consent — is shared with third parties or affiliates for marketing or promotional purposes.
• How we handle this information is described in our Privacy Policy.

No guarantee of pet recovery

TapThisTag makes no warranty, express or implied, that use of its products or services will result in the recovery of a lost pet. The service is provided as-is. TapThisTag is not liable for any failure to reunite a pet with its owner, regardless of the cause, including but not limited to: failure of a finder to tap or scan the tag; lack of an NFC-compatible device; poor cellular or internet connectivity; the tag being obscured, damaged, or unreadable; tag detachment from the collar; NFC chip failure; or any other circumstance beyond TapThisTag’s control.

Pet safety & ingestion warning

TapThisTag products are physical tags made from Thermoplastic Polyurethane (TPU), a flexible plastic material, with an NFC chip sealed inside. While TPU is generally considered non-toxic and does not contain BPA, PVC, or phthalates, you acknowledge and accept the following warnings by purchasing our products:

• Choking and ingestion hazard. If a pet chews, breaks, or detaches the tag and ingests all or part of it, the tag or its components may pose a serious choking hazard or cause an intestinal blockage or other injury, regardless of the non-toxic nature of the materials.
• Aggressive chewers. TapThisTag products are not intended for pets that chew or destroy their collar, tags, or accessories. Remove the tag from your pet’s collar if your pet is known to chew collar accessories.
• Supervision. Periodically inspect the tag and collar attachment ring to ensure the tag is secure, undamaged, and out of reach of your pet’s mouth.
• NFC chip. The tag contains a small NFC chip sealed permanently inside the TPU. If the tag breaks and the chip becomes exposed, keep it away from pets and small children; it contains small electronic components that are not safe for ingestion.
• Veterinary care. If your pet ingests any part of a TapThisTag product, contact your veterinarian or an emergency animal hospital immediately — do not wait for symptoms to appear.

TapThisTag is not liable for any veterinary costs, medical expenses, injury, illness, or death resulting from a pet’s ingestion of or contact with any TapThisTag product.

Tag detachment & physical failure

TapThisTag physical products are consumer goods subject to normal wear and tear, environmental exposure, and the physical activity of pets. We make no warranty that: the tag will remain attached to a collar under all conditions or activities; the tag will remain undamaged by chewing, water, heat, impact, or other environmental factors; the split ring, collar attachment hardware, or any connecting hardware will not fail; or the embedded NFC chip will remain functional indefinitely. The owner is solely responsible for regularly inspecting the tag, split ring, and collar attachment to ensure the tag is securely fastened, undamaged, and readable. TapThisTag is not liable for any loss, injury, or damage — including the loss or death of a pet — resulting from tag detachment, tag damage, split ring failure, collar hardware failure, NFC chip failure, or any other physical failure of the product or its attachment hardware. In the event of a confirmed manufacturing defect (at TapThisTag’s sole determination), our sole obligation is limited to replacement of the defective tag. This does not extend to tags damaged by chewing, environmental exposure, pet activity, or improper use.

Indemnification

You agree to indemnify, defend, and hold harmless TapThisTag, Lead512 LLC, and their officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to: your use of the Service or any TapThisTag product; the information you choose to display on your public profile; your violation of these Terms; your violation of any third party’s rights; or any injury to a person or animal caused by or related to your use of TapThisTag products.

Limitation of liability

To the maximum extent permitted by applicable law, TapThisTag and Lead512 LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, veterinary or medical expenses, property damage, personal injury, or animal injury or death, arising out of or relating to your use of or inability to use the Service or products, even if advised of the possibility of such damages. TapThisTag’s total cumulative liability to you for all claims shall not exceed the amount you paid for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.

Right to remove or deactivate

TapThisTag reserves the right to deactivate any tag or remove any public profile at any time, with or without notice, for any reason including but not limited to violation of these Terms, reports of misuse, safety concerns, or business reasons. Deactivation of a tag does not entitle the user to a refund of the purchase price or any subscription fees paid.

Privacy

Your use of TapThisTag is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described there, including the collection, use, and storage of your personal information and your pet’s information.

Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute arising under or relating to these Terms or your use of TapThisTag products or services shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts. Each party waives the right to a jury trial in any dispute arising under these Terms.

Termination

You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated.

Changes

We may update these Terms; the “Last updated” date above reflects the latest version. Continued use after changes are posted means you accept the updated Terms. Material changes will be communicated by SMS or email to registered users where practicable.
